1. Introduction:

   1. These Terms and Conditions ("Terms") govern your participation in the Smoke & Bacon Media Creator Fund Program ("Program"). By submitting an application to join the Program, you ("Creator") agree to be bound by these Terms.

2. Eligibility:

   1. To be eligible for the Program, Creators must meet the following criteria: a. Be at least 18 years of age or the age of majority in their jurisdiction, whichever is greater. b. Comply with all applicable laws and regulations. c. Create content that aligns with Smoke & Bacon Media's community guidelines and content policies.

3. Application and Approval:

   1. Creators must submit a completed application form to be considered for the Program.

   2. Smoke & Bacon Media will review all applications and select Creators at its sole discretion.

   3. Approval into the Program does not guarantee any specific level of financial support or success.

4. Creator Support Subscription:

   1. Approved Creators will be granted an OPTIONAL Creator Support Subscription, which can be purchased by Smoke & Bacon Media community members to support the Creator.

   2. A portion of the Creator Support Subscription revenue will be donated to a charity of the Creator's choice each month, as indicated in the Creator's application.

   3. The remaining revenue will be distributed to the Creator according to the agreed-upon payout schedule.

   4. Payout Schedule

      1. The Last Friday of Each Month of the calendar year

      2. 80% of the associated creator subscription will be paid to the associated creator

      3. 05% of the associated creator subscription will be paid to the associated creator selected charity on behalf of the creator and Smoke & Bacon Media

      4. 15% of the associated creator subscription will be paid to Smoke & Bacon Media as fees for maintaining systems for the creator

5. Content and Conduct:

   1. Creators must adhere to Smoke & Bacon Media's community guidelines and content policies at all times.

   2. Creators are responsible for all content they publish on the platform and must ensure it complies with applicable laws and regulations.

   3. Smoke & Bacon Media reserves the right to remove content or terminate a Creator's participation in the Program if they are found to be in violation of these Terms, the community guidelines, or content policies.

6. Intellectual Property:

   1. Creators retain ownership of their original content published on the Smoke & Bacon Media platform.

   2. By participating in the Program, Creators grant Smoke & Bacon Media a non-exclusive, worldwide, royalty-free license to use, display, and distribute their content for promotional purposes related to the Program.

7. Termination:

   1. Smoke & Bacon Media reserves the right to terminate a Creator's participation in the Program at any time, with or without cause, upon written notice to the Creator via Email at the creator's email address submitted in their original application.

   2. Creators may terminate their participation in the Program by providing written notice to Smoke & Bacon Media at Info@smokeandbacon.com.

8. Amendments:

   1. Smoke & Bacon Media reserves the right to modify these Terms at any time. Any changes will be posted on the Smoke & Bacon Media website, and it is the Creator's responsibility to review the updated Terms. Continued participation in the Program constitutes acceptance of the modified Terms.

9. Governing Law:

   1. These Terms shall be governed by and construed in accordance with the laws of Virginia USA, without regard to its conflict of law provisions.

10. Disclaimers and Limitation of Liability:

    1. Smoke & Bacon Media provides the Program "as is" without any warranties, express or implied.

    2. Smoke & Bacon Media shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising out of or related to the Program or the use of the Smoke & Bacon Media platform.

11. Indemnification:

    1. Creators agree to indemnify, defend, and hold harmless Smoke & Bacon Media, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses, including legal fees and costs, arising out of or in any way connected with the Creator's content, conduct, or participation in the Program, including but not limited to claims of intellectual property infringement, defamation, or violations of applicable laws and regulations.

12. Privacy:

    1. Smoke & Bacon Media is committed to protecting the privacy of its creators and users. By participating in the Program, Creators agree to the collection, use, and disclosure of their personal information in accordance with Smoke & Bacon Media's Privacy Policy. Creators understand that their personal information may be shared with third parties as necessary for the administration of the Program.

13. Relationship of the Parties:

    1. Creators' participation in the Program does not create an employer-employee relationship, partnership, joint venture, or agency relationship between Smoke & Bacon Media and the Creator. Creators are independent contractors and are solely responsible for any taxes, benefits, and other obligations related to their participation in the Program.

14. Severability:

    1. If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect, and the invalid or unenforceable provision shall be deemed modified to the extent necessary to render it valid and enforceable.

15. Waiver:

    1. No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision, and Smoke & Bacon Media's failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

16. Entire Agreement:

    1. These Terms, together with any other policies or guidelines referenced herein, constitute the entire agreement between the Creator and Smoke & Bacon Media regarding the Creator Fund Program and supersede any prior agreements or understandings, whether written or oral.
